29 CFR 1926.1052(c)(1): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with at least one handrail and one stairrail system along each unprotected side or edge: (a) New townhome construction located on lot #45, First floor stairwell: On or about December 7, 2016, and at times prior, the employer exposed employees to fall hazards up to 11-feet, 5-inches to the lower level, in that a handrail or stairrail was not provided on a temporary staircase used to access the second level.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: (a) New townhome construction located on Lot #45, Second level top plate: On or about December 7, 2016, and at times prior, the employer exposed employees to fall hazards of 23 feet from the lower level, in that a fall protection system was not provided to employees setting roof trusses lowered by a crane to the top plates. Eduardo Leal was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1152814, citation number 1, item number 2 and was affirmed as a final order on 07/21/2016 , with respect to a workplace located at 122 Grand Crescent, Alpharetta, GA 30009.
