29 CFR 1926.451(a)(6): Scaffolds were not designed by a qualified person:  a) At the jobsite, on or about June 7, 2016, two employees performing steel erection activity were elevated and working from an unapproved work platform (a 4 x 4 wooden pallet) that was supported by a GEHL Telescopic Handler Rough Terrain forklift Model: RS6-34, S/N: RS634DH22911, which exposed the employee's to fall hazards up to 16 feet onto the lower concrete and dirt surface.

29 CFR 1926.451(c)(2)(v): The employer used forklifts  to support scaffold platforms without ensuring that the entire platform was attached to the fork and that the forklift was not moved horizontally while the platform was occupied:  a) At the jobsite, on or about June 7, 2016, two employees performing steel erection activity were elevated and working from an unapproved work platform that was supported by a GEHL Telescopic Rough Terrain forklift Model: RS6-34, S/N: RS634DH22911.  The unapproved work platform was not secured to the forks or carriage and was moved horizontally to reposition the employee, which exposed the employee to fall hazards up to 16 feet onto the lower concrete and dirt surface.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.  a) At the jobsite, on or about June 7, 2016, two employees performing steel erection activity were elevated and working from an unapproved work platform that was supported by a GEHL Telescopic Rough Terrain Forklift Model: RS6-34, S/N: RS634DH22911 without the use of fall protection such as, but not limited to personal fall arrest systems or guardrail systems, which exposed the employee to fall hazards up to 16 feet onto the lower concrete and dirt surface.

29 CFR 1926.602(c)(1)(vi): Industrial truck(s) in use did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks.  a) At the jobsite, on or about June 7, 2016, the operator dismounted the GEHL Telescopic handler rough terrain forklift Model: RS6-34, S/N: RS634DH22911 with an occupied unapproved personnel work platform (wooden 4 X 4 pallet) that was elevated and began working above ground level, which exposed employees to fall hazards up to 16 feet onto the lower concrete and dirt surface.
