On or about June 9, 2016, inside the water tank, employees were exposed to fall hazards when accessing a scaffold more than 2 feet above or below a point of access with out using a ladder or approved device.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired. On or about June 9, 2016: a: Outside the water tank where employees were exposed to fall hazards when painting the outside of a water tank on a Werner extension ladder with defective and missing safety feet that was not taken out of service or marked "Do Not Use". b. Outside the water tank a Werner extension ladder with bent side rails was not marked "Do Not Use" and was not taken out of service.
