29 CFR 1926.503(a)(2)(ii): The employer did not assure that each employee, as necessary, had been trained by a competent person in the correct procedures for erecting, maintaining, disassembling and inspecting the fall protection systems that were used:  a)  At 830 US Hwy 98, Daphne, AL 36526: On or about June 3, 2016 and at times prior, the employer exposed employees to fall hazards in that employees were allowed to work installing roof truss' at heights greater than 30 feet without being trained on how to properly erect, maintain, inspect and disassemble the fall protection system that was provided.

29 CFR 1926.502(d)(15): Anchorages used for attachment of personal fall arrest equipment were not independent of any anchorage being used to support or suspend platforms and capable of supporting at least 5,000 pounds per employee attached.  a)  At 830 US Hwy 98, Daphne, AL 36526: On or about June 3, 2016 and at times prior, the employer exposed employees to fall hazards in that employees were allowed to work installing roof truss' at heights greater than 30 feet with the lifeline/rope for the personal fall arrest equipment being attached to 2x4s supporting an interior wall running from the 3rd story floor up and over the rafters overhead.

29 CFR 1926.502(d)(16)(iii): Personal fall arrest systems, when stopping a fall, were rigged such that a employee could free fall more than 6 feet (1.8m) or contact a lower level:  a)  At 830 US Hwy 98, Daphne, AL 36526: On or about June 3, 2016 and at times prior, the employer exposed employees to fall hazards in that employees were allowed to work installing roof truss' at heights greater than 30 feet with the lifeline/rope for the personal fall arrest equipment being attached too close to the edge and with too much slack and while not considering the length of the shock absorber once deployed causing the total fall to be greater than 30 or greater.

29 CFR 1926.501(b)(13): Employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system or personal fall arrest systems:  a)  At 830 US Hwy 98, Daphne, AL 36526: On or about June 3, 2016 and at times prior, the employer exposed employees to fall hazards in that employees were allowed to work installing roof truss' at heights greater than 30 feet without being protected from falling by a guardrail system, safety net system or personal fall arrest system.  b)  At 830 US Hwy 98, Daphne, AL 36526: On or about June 3, 2016 and at times prior, the employer exposed employees to fall hazards in that employees were allowed to access a ladder from the 2nd floor to the 3rd floor that was located on a balcony that had unprotected edges and exposed employees to falls of greater than 10 foot to the ground below.  TEXAS GENERAL BUILDERS, INC. WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.501(B)(13), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 915786, CITATION NUMBER 1, ITEM NUMBER 1 AND WAS AFFIRMED AS A FINAL ORDER ON AUGUST 17, 2013, WITH RESPECT TO A WORKPLACE LOCATED AT 1388 W. I-65 SERVICE ROAD S, MOBILE, ALABAMA, 36609.
