29 CFR 1926.1053(b)(13): The top or top step of a stepladder shall not be used as a step:  a. On the roof at the jobsite, the top step of a 6 foot step ladder was used to climb to the top of a parapet wall, exposing the employee to a 6 foot fall hazard, on or about 6/15/2016.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:  a. At the jobsite, on the roof, fall protection was not provided to an employee installing metal sheathing on the top of a parapet wall, exposing the employee to a 30 foot fall hazard, on or about 6/15/2016.  b. At the jobsite, on the roof above the drive thru window, fall protection was not provided to an employee installing a conductor head as part of the drainage system, exposing the employee to a 10 foot 9 inch fall hazard, on or about 6/15/2016.  Dempsey Roofing Company, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(10), which was contained in OSHA inspection number 951514, citation number 1, item number 1 and was affirmed as a final order on 1/15/2014, with respect to a workplace located at 2456 N. McMullen Road, Clearwater, FL 33759.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a.  At the jobsite, the portable extension ladder used to climb onto the roof area above the drive thru window extended 6 inches past the landing surface, exposing an employee to a 10 foot 9 inch fall hazard, on or about 6/15/2016.   Dempsey Roofing Company, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1053(b)(1) which was contained in OSHA inspection number 951514, citation number 2, item number 1 and was affirmed as a final order on 1/15/2014, with respect to a workplace located at 2456 N. McMullen Booth Road, Clearwater, FL 33759.
