OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling from the elevated forks of a forklift.    On or about June 20, 2016, an employee was standing on the forks of a Gradall 524 rough terrain, telescoping boom forklift while it was in motion and elevated to the roof of the residential home under construction up to approximately 20 feet high, exposing the employee to a fall hazard.

29 CFR 1910.178(l): Operators were not trained in the safe operation of powered industrial trucks:  On or about June 20, 2016, an employee was operating a Gradall 524 rough terrain, telescoping boom forklift without receiving training from the employer, exposing employees to hazards such as, but not limited to being struck by the forklift and falling from the elevated tines of the lift.  In the alternative: 29 CFR 1926.602(d): The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l):Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178.

29 CFR 1926.1053(b)(19): Single rail ladders were being used:  On or about June 20, 2016, five employees were using a job-made ladder that consisted of a 2" X 10" X 8' board that had make-shift rungs screwed into it to access the upper roof section of the residential home under construction, exposing the employees to a fall hazard of approximately 6 feet.
