29 CFR 1926.20(b)(2): Frequent and regular inspections of the job site, materials, and equipment to be conducted by a competent person designated by the employer was not provided by the employer who was responsible to initiate and maintain an accident prevention program:    a- 603, 605, 607 & 609 East 5th Street, Lakewood NJ: A competent person did not conduct frequent and regular inspections of the jobsite.  Employees on this site were exposed to hazards including, but not limited to fall and struck by hazards.  Condition noted on or about 06/20/16.    NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:    a- 603, 605, 607 & 609 East 5th Street, Lakewood NJ: A company employee was exposed to struck by hazards when working beneath employees using hand tools and other unsecured tools/supplies/materials, etc. without the use of any struck by/head protection.  Condition noted on or about 06/20/16. 29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:    a- 603, 605, 607 & 609 East 5th Street, Lakewood NJ: A company employee was exposed to fall hazards, in excess of 25 feet to the ground surface below, when performing framing, carpentry and other related activities from the tops of pitched and flat roof trusses without the use of any fall protection.  It was determined through interviews of the company worksite employees that the worksite company employees had not received any fall hazard recognition or prevention training from the company.  Condition noted on or about 06/20/16.    NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     a- 603, 605, 607 & 609 East 5th Street, Lakewood NJ: A company employee was exposed to fall hazards, in excess of 25 feet to the ground surface below, when performing framing, carpentry and other related activities from the tops of pitched and flat roof trusses without the use of any fall protection.  Condition noted on or about 06/20/16.    Hummingbird Construction, Inc. was previously cited for a Serious violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 926488, citation number 1, item number 2 and was affirmed as a final order on 11/06/13, with respect to a workplace located at 1 Possumtown Road, Piscataway NJ.    NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
