29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program that provides for frequent and regular inspections of job sites, materials, and equipment to be made by a competent person. a} 25 Halsey Street, Lakewood NJ: Subcontractors hired were working from heights greater than 6 feet from the ground below without the use of fall protections. Frequent and regular inspection of the job site to ensure that subcontractors were utilizing fall protection when working from heights. Observed on or about 8/16/2023. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a- 25 Halsey Street, Lakewood NJ: A worker was exposed to fall hazards, in excess of 14 feet 1 inch to the ground surface below, when walking and working from the top plates of a residential structure's outer wall frames while not using fall protection. Condition observed on or about 08/16/23. b - 25 Halsey Street, Lakewood NJ: Workers were exposed to fall hazards, in excess of 9 feet to the flooring below, when walking and working from unsecured floor trusses and the top plates of a residential structure's inner wall frames while not using fall protection. Condition observed on or about 08/16/23 Hummingbird Construction, Inc. was previously cited for a Repeat violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1473357, citation number 1, item number 1 and was affirmed as a final order on 06/24/20, with respect to a workplace located at 175 Quincy Court, Building 2, Quincy Heights, LLC. Perth Amboy, NJ. IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
