29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:    (a) On or about June 21, 2016, and at times prior thereto, framing subcontractor employees were using a Keller, Type III Household Duty aluminum extension ladder to access a flat roof.  The top rung was only slightly above the upper landing surface.    NOTE: Abatement certification is NOT required for this item.  Corrected during inspection.

29 CFR 1926.1053(b)(15): Ladders were not inspected by a competent person for visible defects on a periodic basis and after an occurrence that could affect their safe use:  (a) On June 21, 2016, and at times prior thereto, framing subcontractor employees were using ladder(s) which had not been inspected.  A Keller Type III Household duty aluminum extension ladder was used with multiple bends, dents, and damage.  NOTE: 29 CFR 1926.32(f) defines a "Competent Person" as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them. 29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c) or 29 CFR 1926.652(b).    (a) An employee of the utility and concrete subcontractor was placing a concrete vault for a water meter in a 7.5 feet deep and 8.5 to 9 feet wide trench with vertical walls.    MBA General Construction LLC, dba MBA Construction Company was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 404023, citation number 1, item number 2b, and was affirmed as a final order on July 20, 2012, with respect to a workplace located at 110 Vista, Pocatello, ID 83201.
