29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person: a) Homestead Assisted Living Building #4: On or about June 15, 2016, and at times prior thereto, the employer did not perform frequent and regular inspections of sites that controlled and identified, correct and/or eliminate hazards to which their employees and/or the employees of subcontractors were exposed. Hazards include but are not limited to potential falls while accessing the second floor patio without a sufficient guardrail. Note: Abatement certification IS required for this item.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: a) Second Floor Patio, Rexburg, Idaho: On or about June 15, 2016, the controlling employer, Headwaters Construction Company installed a cable guard-railing system and did not ensure that it maintained 42 inches, plus or minus 3 inches above the walking/working level, exposing sub-contracted employees to an approximate 13 foot fall hazard. Note) Abatement certification and documentation ARE required for this item. The controlling employer, Headwaters Construction Company was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(1), which was contained in OSHA inspection number 900741, citation number 1, item number 1 and was affirmed as a final order on 7/19/2013, with respect to a workplace located at 2023 West 2000 South, Rexburg, ID 83440.
