29 CFR 1910.134(c)(2)(i): The employer did not determine if the voluntary use of a respirator did not in itself create a hazard:  On or about September 09, 2016 employees working in the Pharmacy and Pharmacy Clean Areas were exposed to hazards associated with the use of respirators where the employer provided "Moldex" series 7000 and "3M" series 6300 tight fitting respirators for voluntary use and fit tested the employees but did not provide affected employees with a medical evaluation to determine if the respirator would create a hazard prior to use or being fit tested.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user:   On or about September 09, 2016 employees working in the Pharmacy and Pharmacy Clean Areas were exposed to hazards associated with the use of respirators where the employer provided "Moldex" series 7000 and "3M" series 6300 tight fitting respirators for voluntary use and fit tested employees but did not develop and implement a written respiratory protection program.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.134(k)(6): The employer did not provide the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134, in written or oral format to employees who wear respirators when such use was not required by the employer:  On or about September 09, 2016 employees working in the Pharmacy and Pharmacy Clean Areas were exposed to hazards associated with the use of respirators where the employer provided "Moldex" series 7000 and "3M" series 6300 tight fitting respirators for voluntary use but did not provide employees with advisory information in Appendix D of 29 CFR 1910.134.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1904.40(a): The employer did not provide an authorized government representative the records within the four business hours.  On or about June 24, 2016 the employer did not provide copies of the OSHA form 300 for the years 2013 through 2016 or the OSHA form 300A for the years 2013 through 2015 within four hours of the document request by an authorized representative of the US Department of Labor, OSHA.
