29 CFR 1915.77(c): When employees are working aloft, or elsewhere at elevations more than 5 feet above a solid surface, the employer did not provide either scaffolds or a sloping ladder, meeting the requirements of this subpart, to afford safe footing, and the employees were not protected by safety belts and lifelines meeting the requirements of 1915.159 and 1915.160: a) At Crimson Clove Barge Mobile, Alabama: On or about June 18, 2016 and at times prior; the employer failed to ensure employees involved in the cut out and replacement of a ladder in a barge holding tank were using fall protection exposing them to a fall hazard of 15 feet to the barge bottom below.
