OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a) This violation occurred on or about June 28, 2016 when an employee working from the elevated basket of an aerial lift located inside a highway construction buffer zone was exposed to a struck by hazard from moving traffic. Among other methods, a feasible and acceptable means of abatement is to ensure employees working from an aerial lift stay within the work space.
