OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: Freezer Area: On or about June 29, 2016 and at times prior thereto, employees operating Mitsubishi and Daewoo seatbelt-equipped forklift trucks were not utilizing the restraint devices. This condition exposed employees to caught between hazards in the event of vehicle tipover. Among other methods, the employer could direct the employees to utilize the seatbelt-equipped forklifts when operating the equipment.
