29 CFR 1926.300(a): All hand and power tools and similar equipment, whether furnished by the employer or employee, were not maintained in a safe condition: (a) 2941 Main Street Morgantown, PA - The employer allowed employees to use an unapproved Dewalt 12 inch 32 tooth carbide tip saw blade on a Husqvarna K 760 concrete saw that was designed for a diamond blade or an abrasive blade. The saw was not equipped with a guard at the bottom of the saw to protect the exposed potation of the blade, thereby causing injury on or about July 5, 2016. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered: (a) 2941 Main Street Morgantown, PA - An employee using a chain saws to cut up fell trees was exposed to a hazard of contact with the moving blade. The employer did not require the exposed employee to wear leg protection, including but not limited to chaps, thus exposing the employee to laceration injuries, on or about July 5, 2016. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
