29 CFR 1910.133(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a) Store paint mixing area:  On or about July 7, 2016 and at times prior thereto; employees were mixing paints to include lacquers, polyurethanes and using thinners without the protection of safety goggles or safety eyewear with side shields to protect against splashes or flying particles.  b) Warehouse: On or about July 7, 2016 and at times prior thereto; employees were making spray paint cans for lacquers, polyurethanes, acrylic and latex paints and using thinners without the protection of safety goggles or safety eyewear with side shields to protect against splashes or flying particles.  *Note Abatement certification IS required for this item.

29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible:  a) Retail Store & Warehouse: On or about July 7, 2016 and at times prior thereto; employees shared one half-face respirator while performing paint mixing operations, but they did not clean and disinfect the shared mask in between uses because they had not been given the guidance found in Appendix D. 29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until it was restored to safe operating condition.    a) Warehouse:  On or about July 7, 2016 and at times prior thereto; A Powered Industrial Truck (PIT) operator was observed unloading and moving materials from a supplier's truck, but the brakes on the forklift were not in full operational order, causing the operator to stop approximately a foot back in order to come to a safe complete stop.
