29 CFR 1926.651(h)(1): Employer permitted employees to work in excavations in which there was accumulated water, and in excavations in which water was accumulating. No precautions were taken to protect employees against the hazards posed by water accumulation. This violation occurred on July 5, 2016. Employees working at the base of the trench were exposed to cave-in hazards.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: Employees were exposed to cave-in hazards while working in an excavation when entering and exiting a trench approximately 11-feet deep. No protective system on the face of trench wall where ladder was placed. 4 M Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard which was contained in OSHA inspection number 1079302, citation number 1, item number 1b and was affirmed as a final order on August 25, 2015, with respect to a workplace located at 708 E. College Street, Athens, Texas.
