OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard where a portable metal ladder was not used as intended by the manufacturer.    a. Site- An employee accessing the below grade water pump building daily to conduct inspections and periodic maintenance was not protected from a fall hazard where a straight metal pool ladder, which was not intended to be a portable ladder and did not extend 3 feet above the access point, was utilized for access.

29 CFR 1910.24(b): Fixed stairs were not provided were access to elevations was daily or at each shift for such purposes as gauging, inspection, regular maintenance:  a. Site- An employee accessing the below grade water pump building daily to conduct inspections and periodic maintenance was not protected from a fall hazard where a straight metal pool ladder, intended to be fixed and the top rung was located approximately 12 inches below the access opening to the building, was utilized instead of a fixed stair.

29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered:    a. Site- Employees walking down the green Westwind Leisure Group Ltd waterslide during their daily inspection of the waterslide are not protected from a fall of approximately 25 feet where the side walls of the waterslide are approximately 28 inches tall and personal fall arrest equipment is not utilized.
