29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): On or about 12 July 2016, at the above addressed jobsite, three employees were working on the 2nd floor deck of a townhome under construction while tying rebar, without the use of fall protection, exposing the employees to a fall hazard of approximately 12 feet and 6 inches to the ground below. The CMG Development, LLC. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501 (b)(13), which was contained in OSHA inspection number 958775, citation number 1, item number 2 and was affirmed as a final order on 6/12/2014, with respect to a workplace located at 350 NE 6th Avenue, Miami, FL 33179.
