29 CFR 1910.134(a)(2): A respirator shall be provided to each employee when such equipment is necessary to protect the health of such employee. The employer shall provide the respirators which are applicable and suitable for the purpose intended. The employer shall be responsible for the establishment and maintenance of a respiratory protection program, which shall include the requirements outlined in paragraph (c) of this section. The program shall cover each employee required by this section to use a respirator: On 07/19/2016, an employee from U.S. Roofing was working at 1210 Bramblett Drive, OFallon, MO. The employee as cutting (sawing) James Hardie Fiber Cement siding. This concrete siding contained 10-30% Crystalline Silica and 10-60% Calcium Silicate. The employee did not have a respirator to protect himself from the Silica dust being generated. The employer shall be responsible for a respiratory protection program, which shall comply with 1910.134(c).

29 CFR 1926.453(b)(2)(iv): Employees shall always stand firmly on the floor of the basket, and shall not sit or climb on the edge of the basket or use planks, ladders, or other devices for a work position: On 07/19/2016, an employee from U.S. Roofing was working at 1210 Bramblett Drive, OFallon, MO. An employee was not standing firmly on the floor of the elevated Genie S-60 aerial lift basket while performing his work duties. The lifts basket was over 25 feet above the lower level.

29 CFR 1926.453(b)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift: Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e). On 07/19/2016, an employee from U.S. Roofing was working at 1210 Bramblett Drive, OFallon, MO. Two employees were working on the newly constructed residential apartment building without being attached to the boom or basket with a full body harness and lanyard. The lifts basket was over 25 feet above the lower level.
