Citation 1, Item 1 Section 5(a)(1): Respondent L.E. Meyers Company, did not furnish employment and a place of employment which were free from recognized hazards that caused or were likely to cause death or serious physical harm which resulted in employee exposure as follows: a) Jobsite: Kanawha State Forest, Polly Hollow, Charleston, WV - On July 18, 2016, an employee removed all the bolts from one of the legs of lattice steel tower 151-40 before the winch line was attached to the tower to ensure stability of the structure; the tower collapsed as a result. b) Feasible means of abatement include the following: Before any efforts to disassemble the lattice steel tower are undertaken, winch line(s) must be first attached to the tower to ensure the stability of the structure.

29 CFR 1926.858(c): Steel construction was not dismantled column length by column length, and tier by tier: (a) Structure 151-40: On or about July 18, 2016 and times prior, the 100 foot 6 inch steel lattice electrical transmission tower was dismantled by removing and loosening bolts at each leg splice on the face and side of each leg, at a height of approximately 25 feet from the ground. Work was conducted on the first level below 4 splices, 9 sets of lacing, 3 wire tension arms, and 75 feet of steel, in preparation of pulling the tower over with a dozer.
