29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift: a) On or about 07-20-16 at Brown Street and Edison Street in Mosinee, the employer did not conduct an adequate safety inspection prior to employees working in an approximately 25 ft. L x 7 ft. W x 7.5 ft. D trench. Complete soil testing and classification was not conducted and required cave-in protection was not utilized.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: a) On or about 07-20-16 at Brown Street and Edison Street in Mosinee, employees were working in an approximately 25 ft. L x 7 ft. W x 7.5 ft. D trench without adequate cave-in protection. The employer had constructed the walls at an approximate 45 deg. angle and not the required 34 deg.
