29 CFR 1926.95(a): "Application." Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact.    Steen Construction, Inc. project site located at the intersection of N. 2nd St. and Chicago Ave. Wausau, WI: On and about June 13, 2017, an employee cutting ductile pipe with a gas powered cut off saw was not using safety glasses or hearing protection to protect himself from flying sparks and extreme noise.

29 CFR 1926.251(a)(2)(i): Has permanently affixed and legible identification markings as prescribed by the manufacturer that indicate the recommended safe working load;    Steen Construction Inc. project site located at the intersection of N. 2nd St. and Chicago Ave. Wausau, WI: On and about June 13, 2017, employees were exposed to struck by hazards while handling pipe and sewer structures with a 3/8" grade 70 chain assembly which was not rated for lifting and was not marked with tag indicating its safe working load.

29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when:  29 CFR 1926.652(a)(1)(ii): Excavations are less than 5 feet (1.52 m) in depth and examination of the ground by a competent person provides no indication of a potential cave-in.    On and about June 13, 2017, employees were exposed to engulfment while working in an excavation that was 10' deep when cave in protection was not provided, sloping was not acceptable for the soil type, and fissures and sloughing were visible in the excavation walls.
