29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: The employer did not provide a hearing conservation program for employees who were exposed to daily noise levels above the OSHA Action Level of 85 dBA or 50% of the daily dose. (a) On August 10, 2016, an employee was exposed to an eight hour time weighted average (TWA) noise level of 88.3 decibels on the A scale (dBA) or 79.5% of the daily dose for the 440 minute sampling period with a value of zero added for the 40 minutes not sampled. (b) On August 10, 2016, an employee was exposed to an eight hour TWA noise level of 88.04 dBA or 76.2% of the daily dose for the 400 minute sampling period with a value of zero added for the 80 minutes not sampled. (c) On August 10, 2016, an employee was exposed to an eight hour TWA noise level of 86.9 dBA or 65.2% of the daily dose for the 415 minute sampling period with a value of zero added for the 65 minutes not sampled. (d) On August 10, 2016, an employee was exposed to an eight hour TWA noise level of 86.2 dBA or 58.8% of the daily dose for the 391 minute sampling period with a value of zero added for the 89 minutes not sampled. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
