29 CFR 1910.178(l)(2)(i)(A): The employer did not ensure trainees operated a powered industrial truck only under the direct supervision of persons who have the knowledge, training, and experience to train operators and evaluate their competence. a) On or about July 27, 2016, a powered industrial truck trainee was operating a forklift without direct supervision from the trainer providing training to the trainee. In accordance with 29CFR 1903.19(d), abatement certification is required for this violation (using CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement or other written records.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: a) On or about July 15, 2016, Mandel Metals, Inc. failed to provide machine guarding for the cut to length line stacker to protect employees from moving and rotating parts during its operation. Employees were exposed to crush hazards when performing manual stacking of material inside of the stacker from the stacker's lift table. In accordance with 29CFR 1903.19(d), abatement certification is required for this violation (using CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement or other written records.
