29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:    (a) On or about July 27, 2016, the employer failed to establish and implement a written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) where respirator use is required. Employees who wear respirators as part of range cleaning duties are exposed to toxic substance hazards in that no provisions have been made for medical evaluation, fit testing, and training in respirator use, care, and storage.    Abatement certification is required for this item; use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose.

Employees performing range attendant or range cleaning duties in the shooting range area were exposed to toxic substance hazards from airborne lead. 29 CFR 1910.1025(h)(1): All surfaces were not maintained as free as practicable of accumulations of lead:    (a)On or about July 27 2016, the employer failed to maintain all surfaces as free as practicable of accumulations of lead. Employees were exposed to surface accumulations of lead in the following instances:    (1) In the employee restroom, on the sink faucet and handles, lead was present at 2016.3000 micrograms in a 100 square centimeter sample. In the employee restroom, on the light switch, lead was present at 71.2920 micrograms in a 100 square centimeter sample.    (2) On a table in the range lobby, lead was present at 104.5000 micrograms in a 100 square centimeter sample.    (3)On the counter inside the range attendant's booth, lead was present at 48.5030 micrograms in a 100 square centimeter sample.     (4) On the kitchen counter, in front of the coffee maker and dish drying rack, lead was present at 13.7390 micrograms in a 100 square centimeter sample.    Abatement certification is required for this item; use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose.

(a) The employer is failing to protect employees from toxic lead hazards by providing information classifying the hazards of lead, including reproductive/developmental toxicity; central nervous system effects; kidney effects; blood effects; and acute toxicity effects. This was most recently documented on or about July 27, 2016, when the employer failed to demonstrate that this information was included in Hazard Communication training of employees. Employers must ensure that each employee has access to labels on containers of lead and to safety data sheets, and is trained in accordance with the requirements of HCS and paragraph (l) of this section.
