29 CFR 1910.1025(m)(1)(ii): In classifying the hazards of lead at least the following hazards are to be addressed: Reproductive/developmental toxicity; central nervous system effects; kidney effects; blood effects; and acute toxicity effects.  (a) The employer is failing to protect employees from lead-related hazards. This was most recently documented on or about April 12, 2017, when the employer failed to demonstrate that information classifying the hazards of lead, including reproductive/developmental toxicity; central nervous system effects; kidney effects; blood effects; and acute toxicity effects. In the employee restroom, on the sink faucet and handles, lead was present at 128.20 micrograms in a 100 square centimeter sample.   (b)The employer is failing to protect employees from lead-related hazards. This was most recently documented on or about April 12, 2017, when the employer failed to demonstrate that information classifying the hazards of lead, including reproductive/developmental toxicity; central nervous system effects; kidney effects; blood effects; and acute toxicity effects. On the counter inside the range office, lead was present at 94.67 micrograms in a 100 square centimeter sample.  (c) The employer is failing to protect employees from lead-related hazards. This was most recently documented on or about April 12, 2017, when the employer failed to demonstrate that information classifying the hazards of lead, including reproductive/developmental toxicity; central nervous system effects; kidney effects; blood effects; and acute toxicity effects. On a table in the range lobby, lead was present at 37.99 micrograms in a 100 square centimeter sample.  (d) The employer is failing to protect employees from lead-related hazards. This was most recently documented on or about April 12, 2017, when the employer failed to demonstrate that information classifying the hazards of lead, including reproductive/developmental toxicity; central nervous system effects; kidney effects; blood effects; and acute toxicity effects. On the kitchen counter, in front of the dish drying rack, lead was present at 31.05 micrograms in a 100 square centimeter sample.  (e) The employer is failing to protect employees from lead-related hazards. This was most recently documented on or about April 12, 2017, when the employer failed to demonstrate that information classifying the hazards of lead, including reproductive/developmental toxicity; central nervous system effects; kidney effects; blood effects; and acute toxicity effects. On the kitchen counter, in front of the coffee maker lead was present at 23.44 micrograms in a 100 square centimeter sample.  (f) The employer is failing to protect employees from lead-related hazards. This was most recently documented on or about April 12, 2017, when the employer failed to demonstrate that information classifying the hazards of lead, including reproductive/developmental toxicity; central nervous system effects; kidney effects; blood effects; and acute toxicity effects. In the employee restroom, on the light switch, lead was present at 19.90 micrograms in a 100 square centimeter sample.  The API Investors LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.1025(m)(1)(ii), (which was contained in OSHA inspection number 1164970, citation number 1, item number 5a and was affirmed as a final order on December 23, 2016, with respect to a workplace located at 1700 W Mechanic Street, Harrisonville, Missouri 64701.  Abatement certification is required for this item; use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose.

Employers must ensure that each employee has access to labels on containers of lead and to safety data sheets, and is trained in accordance with the requirements of HCS and paragraph (l) of this section:  (a) The employer is failing to protect employees from lead-related hazards. This was most recently documented on or about April 11, 2017, when the employer failed to demonstrate that each employee was trained in accordance with the requirements of the Hazard Communication standard and paragraph (l) of this section. In the employee restroom, on the sink faucet and handles, lead was present at 128.20 micrograms in a 100 square centimeter sample. This was most recently documented on or about April 11, 2017, when the employer failed to demonstrate that each employee was trained in accordance with the requirements of the Hazard Communication standard and paragraph (l) of this section.
