29 CFR 1910.120(q)(2): The employer did not develop an emergency response plan for emergencies which addressed the following minimum requirements of this standard: 1910.120(q)(2)(i) through 1910.120(q)(2)(xii): (a) Yuma Ethanol, LLC, at 38480 CR H, Yuma, CO: On and preceding March 17, 2016, the employer did not develop an emergency response plan for emergencies that included all of the elements of the plan (i) through (xii) stated in this paragraph. The site included an ethanol processing facility, and included 95,026 pounds of anhydrous ammonia. The emergency response plan was deficient in that it failed to include all of the following elements: (i) Pre-emergency planning and coordination with outside personnel; (ii) Personnel roles, lines of authority, training, and communication; (iii) Emergency recognition and prevention; (iv) Safe distances and places of refuge; (v) Site security and control; (vi) Evacuation routes and procedures; (vii) Decontamination; (viii) Emergency medical treatment and first aid; (ix) Emergency alerting and response procedures; (x) Critique of response and follow-up; and (xi) PPE and emergency equipment This condition exposed employees to explosion and burn hazards, and chemical hazards including toxic inhalation hazards and corrosive exposure from skin and eye contact.

29 CFR 1910.120(q)(6)(ii): First responders at the operational level did not receive at least eight hours of training or did not have sufficient experience to objectively demonstrate competency in the areas required by 29 CFR 1910.120(q)(6)(ii)(A) through (q)(6)(ii)(F) and/or the employer did not so certify: (a) Yuma Ethanol, LLC, at 38480 CR H, Yuma, CO: On and preceding March 17, 2016, the employer did not ensure that maintenance and operator employees directed to respond to releases in a defensive manner, without actually trying to stop the release, were adequately trained. This includes employees who were directed to contain the release from a safe distance, keep it from spreading, and prevent exposures. The employer did not ensure and certify that employees had at least eight hours of training, or had sufficient experience, in the following areas: Knowledge of the basic hazard and risk assessment techniques; Know how to select and use proper personal protective equipment provided to the first responder operational level; An understanding of basic hazardous materials terms; Know how to perform basic control, containment and/or confinement operations within the capabilities of the resources and personal protective equipment available with their unit; Know how to implement basic decontamination procedures; and An understanding of the relevant standard operating procedures and termination procedures. This condition exposed employees to explosion and burn hazards, and chemical hazards including toxic inhalation and corrosive exposure from skin and eye contact.

29 CFR 1910.120(q)(6)(iii): Employees who participated as hazardous materials technicians, or were expected to participate as hazardous materials technicians, had not received at least 24 hours of training equal to the first responder operations level, and in addition have competency in the areas outlined in 29 CFR 1910.120(q)(6)(iii)(A) through (q)(6)(iii)(I) and/or the employer did not so certify: a) Yuma Ethanol, LLC, at 38480 CR H, Yuma, CO 80759: On and before March 17, 2016, the employer did not ensure that employees and contractors who respond to releases or potential releases of hazardous materials for the purpose of stopping the release are adequately trained as hazardous materials technicians. The employer did not certify that these employees have been trained as hazardous materials technicians. These individuals were not trained to have competency in all of the following areas: Know how to implement the employer's emergency response plan; Know the classification, identification, and verification of known and unknown materials by using field survey instruments and equipment; Be able to function within an assigned role in the Incident Command System; Know how to select and use proper specialized chemical personal protective equipment provided to the hazardous materials technician; Understand hazard and risk assessment techniques; Be able to perform advance control, containment, and/or confinement operations within the capabilities of the resources and personal protective equipment available with the unit; Understand and implement decontamination procedures; Understand termination procedures; and Understand basic chemical and toxicological terminology and behavior. This condition exposed employees to explosion and burn hazards, and chemical hazards including toxic inhalation and corrosive exposure from skin and eye contact.
