29 CFR 1910.1200(g)(8): The employer did not ensure that material safety data sheets were readily accessible to the employees in their work area during each work shift: (a) On July 28, 2016, the security guard on duty was not provided with access to safety data sheets when an employee was hospitalized for suspected chemical exposure, and the security guard could not provide information to the medical provider on the chemical to which the employee was exposed. (b) On July 28, 2016, Nick Bohlke, president of MB Manufacturing, did not have access to safety data sheets during the plant shut down when an employee was hospitalized for suspected chemical exposure, and Nick Bohlke could not provide information to the medical provider on the chemical to which the employee was exposed. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
