29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary: On or about 8/1/16, during residential sewer activities, the employer failed to ensure that the excavated material of the trench, located at 192 Brookfield Rd. Avon Lake, Oh 44012, was kept at a distance of at least 2 feet from the edge of the excavation opening. The excavated material was about 12 inches from the edge of the trench where the employee was conducting work.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: On or about 8/1/16, during residential sewer activities, the employer failed to ensure that employees were provided cave-in protection when employees are expected to enter an excavation greater than 6.5 feet in depth, with respect to the trench located at 192 Brookfield Rd. Avon Lake, Oh 44012. Note: American Plumbing, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard which was contained in OSHA inspection number 1045397, citation number 1, item number 2 and was affirmed as a final order on April 8th, 2015, with respect to a workplace located at 3100 Redwood Rd. Avon Lake, Ohio.
