29 CFR 1926.651(i)(3):Sidewalks, pavements, or appurtenant structures had been undermined and a support system or another method was not provided to protect employees from the possible collapse of such structures: On or about June 17, 2024 the employer did not ensure that employees working inside an excavation were protected from the collapse or failure of the residential driveway which was undermined as part of the excavation. Employees were observed working inside the excavation directly under the driveway section.

29 CFR 1926.651(j)(2):Employees were not protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations, or by a combination of both if necessary: On or about June 17, 2024, the employer did not ensure that soil spoil piles from the excavation were more than 2 feet from the excavation in which employees were observed working. At the time of inspection the soil pile was placed directly next to and near the edge of the excavation.

29 CFR 1926.652(a)(1):Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c); On or about June 17, 2024 the employer did not ensure that adequate cave-in protection was provided to employees working inside an excavation at a residential site. Employees were observed working outside of the provided shoring without the presence of cave in protection.
