29 CFR 1904.39(a)(2): Basic Requirement. Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA. On or about July 22, 2016, the employer failed to report to OSHA an in-patient hospitalization of on an employee. The employer has failed to report an in-patient hospitalization to OSHA within 24 hours. This most recent occurrence of this took place at the facility located at 1850 P Street, Lincoln, NE where on July 22, 2016 the employer had an employee struck in the head by debris thrown out the fifth floor window of a new apartment construction project. The employee was taken by a fellow employee to a local hospital where the employee was admitted and treated for head and neck trauma. The employer did not report the incident to OSHA until July 26th.
