29 CFR 1910.22(a): Housekeeping. 29 CFR 1910.22(a)(1): All places of employment, passageways, storerooms, and service rooms shall be kept clean and orderly and in a sanitary condition. On or about August 3, 2016, the employer had not performed housekeeping as part of a comprehensive housekeeping plan for the Secondary department. Housekeeping was not performed to reduce the risk for fire and potential for deflagration of combustible metal dust (a mixture of steel and graphite dust) associated with abrasive blasting operations and related equipment. On August 2, 2016, there was a fire involving overhead deposited material on structural steel building components and other overhead equipment.

29 CFR 1910.132(a): Application. Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact. On or about August 3, 2016, the employer had not provided or required the use of personal protective equipment, including but not limited to appropriately rated protective clothing for protection against flash fire hazards associated with combustible metal dust generated from abrasive blasting operations in the Secondary department. Equipment operators and maintenance employees have exposure to combustible metal dust during routine operations, maintenance and service activities and drum change out.

29 CFR 1910.132(d)(1): Hazard assessment and equipment selection. 29 CFR 1910.132(d)(1): The employer shall assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE). If such hazards are present, or likely to be present, the employer shall: 29 CFR 1910.132(d)(1)(i): Select, and have each affected employee use, the types of PPE that will protect the affected employee from the hazards identified in the hazard assessment; On or about August 3, 2016, the employer had not addressed the physical hazards associated with combustible metal dust operations in the Secondary department in the workplace hazard assessment. Equipment operators and maintenance employees have exposure to combustible metal dust during regular operations, maintenance and service activities and when drums are changed out. These employees are exposed to a metal dust flash fire hazard during these activities that were performed without personal protective equipment appropriate for the hazard.

29 CFR 1910.1200(f)(6): Labels and other forms of warning - Workplace labeling. Except as provided in paragraphs (f)(7) and (f)(8) of this section, the employer shall ensure that each container of hazardous chemicals in the workplace is labeled, tagged or marked with either: 29 CFR 1910.1200(f)(6)(ii): Product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals, and which, in conjunction with the other information immediately available to employees under the hazard communication program, will provide employees with the specific information regarding the physical and health hazards of the hazardous chemical. On or about August 6, 2016, the employer had not ensured that drums containing combustible dust produced by abrasive blasting operations in the Secondary department were properly labeled, tagged or marked. There are four abrasive blasting operations with dust collection equipment that have individual drums that collect this hazardous chemical associated with Secondary department production processes. Secondary department equipment operators and maintenance employees have daily exposure to the physical hazards of fire and explosion associated with this combustible metal dust.

29 CFR 1910.1200(h): "Employee information and training." 29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets. On or about August 3, 2016, the employer had not provided information and training on hazardous chemicals in the secondary department. Employees had not received training and information on the physical hazards associated with hazardous chemicals produced by abrasive blasting processes in the secondary department. Equipment operators and maintenance employees have increased risk for injury associated with the potential fire and explosion hazards of the energetic material produced by these operations.
