29 CFR 1904.39(a)(2): Basic Requirement. Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA. On or about July 22, 2016, the employer failed to report to OSHA an in-patient hospitalization of on an employee. The employer has failed to report an in-patient hospitalization to OSHA within 24 hours. This most recent occurrence of this took place at the facility located at 1850 P Street, Lincoln, NE where on July 22, 2016 the employer had staffed an employee to Aspen Heights Construction, Inc. and that employee was struck in the head by debris thrown out the fifth floor window of a new apartment construction project. The employee was taken by a fellow employee to a local hospital where the employee was admitted and treated for head and neck trauma. The employer never reported the incident to OSHA, the host employer reported the incident on July 26th.
