OSH ACT of 1970 Section (5)(a)(1): Public Law 91-596, the Occupational Safety and Health Act of 1970, Section 5(a)(1):  The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or are likely to cause death or serious physical harm to his employees, in that employees were exposed to: falling 22 feet to a lower level.   (a)  Ridge Frame - On or about August 1, 2016 four employees were exposed to a fall hazard while working in a Genie GS 2632 scissors lift (serial no. 5302) that was over its occupant capacity.  Employees were elevated 22 feet above a concrete surface.

29 CFR 1926.760(a)(1): Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems.   (a)  Ridge Frame - On or about August 1, 2016 four employees were exposed to a fall hazard while working on the edge a roof 22 feet above a concrete surface without a guardrail system or safety net system or personal fall arrest system.      GANDY STEEL ERECTION WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.760(a)(1) WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 940615 CITATION NUMBER 1, ITEM NUMBER 1, ISSUED ON 09/16/13, WITH A FINAL ORDER DATE OF 10/16/2013, WITH RESPECT TO A WORKPLACE LOCATED AT 1012 MISSISSIPPI STREET, JACKSON, MS 39201.

29 CFR 1910.178(m)(5)(i): When a powered industrial truck is left unattended, load engaging means were not fully lowered, controls were not neutralized, power was not shut off, and brakes set:   (a)   Construction Site - On or about August 1, 2016 a GEHL Forklift had its forks elevated and unattended. There was no one at the controls of the forklift while the forks were elevated.
