OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards caused by a Laddervator roof shingle hoist which had a hoisting cable that was rusted, frayed, kinked and bent, and which was not set-up in a secure stable manner:  (a) Worksite:  On 8/5/2016, employees were exposed to struck-by hazards from working with or near an improperly maintained Laddervator roof shingle hoist with a rusted damaged cable. The equipment was not secured to prevent movement, and not set-up on a solid level surface.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):   (a)  Worksite - Roof:  On or about 8/5/2016, employees were not protected from falling while working on a roof approximately seventeen feet above a lower level.  Jenkins Home Improvement was previously cited for a violation of this occupational safety and health standard which was contained in OSHA inspection number 314919879, citation number 001, item number 01b and was affirmed as a final order on 12/5/2011, with respect to a workplace located at 90 Slade Street, Pawtucket RI, 02860.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:   (a) Worksite:  On or about 8/5/2016, the employer did not provide adequate training for the employees who might be exposed to fall hazards.
