29 CFR 1926.453(b)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e). (a) Pool Parapet - On or about August 3, 2016 four employees were exposed a fall hazard while riding in a Skyjack SJ66T Boom Lift serial no. 1013165 was elevated 16 feet 8 inches above the ground without fall protection. Also this aerial lifts occupancy capacity was exceeded. This aerial lift has maximum occupancy of 2 passengers.

29 CFR 1926.453(b)(2)(vi): Boom and basket load limits specified by the manufacturer shall not be exceeded. (a) Pool Parapet - On or about August 3, 2016 four employees were exposed a fall hazard while riding in a Skyjack SJ66T Boom Lift serial no. 1013165 due to an exceeded occupancy capacity. This aerial lift has a warning sticker on the front that reads Maximum of 2 Occupants or 500 lbs. All four of these employees were elevated 16 feet 8 inches above the ground without fall protection. The operators manual also states maximum capacity of 2 occupants.

29 CFR 1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. (a) Pool Parapet - On or about August 3, 2016 employees were exposed a fall hazard while working on the edge of a roof without fall protection. Employees were walking and standing on top of the parapet wall with no fall protection.

29 CFR 1910.178(m)(5)(i): When a powered industrial truck is left unattended, load engaging means shall be fully lowered, controls shall be neutralized, power shall be shut off, and brakes set. Wheels shall be blocked if the truck is parked on an incline. (a) Pool Parapet - On or about August 3, 2016 a JGL Skytrak 10054 Forklift serial no. 10096241 was left elevated and unattended. There was no one at the controls of the forklift while the boom was up.
