OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to slip/trip/fall hazards while unloading dry good trailers: a) Insufficient lighting in that no dock lights were installed or other lighting available while employees unloaded trailers at the dock area. b) Employees used electric pallet jacks to move containers without the ability to see damaged areas of the wood floors. c) Employees could step into damaged flooring or get the wheels of the electric pallet jack stuck resulting in trip/slip/fall hazards or strike against the pallet jack control arm.

29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toe boards:  a) On or about August 23, 2016 and times prior at the sizer line elevated walkways; fall hazard: The employer failed to ensure employees had proper equipment to reach product from the conveyor belt without leaning their body half way through the top and mid rails exposing employees to fall hazards of 4 feet 4 inches to the concrete floor.  b) On or about August 23, 2016 and times prior at the sizer line #1 elevated walkway; fall hazard: The employer failed to ensure proper mid-rail chains were maintained which allowed employees to walk past an access point missing the mid-rail chain exposing employees to fall hazards of 4 feet 4 inches to the concrete floor.  c) On or about August 23, 2016 and times prior at the sizer line elevated walkways; fall hazard: The employer failed to ensure proper mid-rail chains were maintained at the ends of platforms with a fixed ladder installed which allowed employees to walk/work/stand near the end which had missing mid-rail chains, exposing employees to fall hazards of 4 feet 4 inches to the concrete floor.
