29 CFR 1926.1052(c)(1): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with at least one handrail and one stairrail system along each unprotected side or edge: a) On or about 8/15/16, at the Elk Terminal Lofts Construction Project, 230 Scott St., Buffalo, NY: Employees were exposed to a potential fall down the Unit 34 B stairway leading from the second floor, down 7 steps to an intermediate landing, then making a 90 degree turn to the right and down another 13 steps to the dock level. Each section of the stairway was enclosed on both sides and neither section had a handrail installed on at least one side. Additionally, there were five other stairways in service on the east side of the building from the dock to the second floor, that also lacked handrails. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.1052(c)(4): Midrails, screens, mesh, intermediate vertical members, or equivalent intermediate structural members were not provided between the top rail of the stairrail system and the stairway steps: a) On or about 8/15/16, at the Elk Terminal Lofts Construction Project, 230 Scott St., Buffalo, NY: Employees used two stairways outside, on the east side of the building to access and exit the dock area from the ground. Both stairways had 6 risers, and the sides of the stairways were not enclosed. A stair rail was installed on each side of the stairways, but there was no intermediate member installed such as a midrail between the top rail and the steps. NO ABATEMENT CERTIFICATION REQUIRED
