29 CFR 1926.404(f)(6): The path to ground from circuits, equipment, or enclosures was not permanent and continuous: a) On or about 8/15/16, on the second floor at the Elk Terminal Lofts Construction Project, 230 Scott St., Buffalo, NY: A Maxx Air Pro Industrial Drum fan was used to provide ventilation. The fan was connected to 120 volt-ac power via a series of two extension cords, the first of which was plugged into a receptacle in a temporary power distribution center. The markings on that first extension cord in the series said Empire Building Diagnostics Inc. The cord lacked a ground prong on its plug. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.502(b)(2): Midrails, screens, mesh, intermediate vertical members, or equivalent intermediate structure members were not installed between the top edge of the guardrail system and the walking/working surface when there was no wall or parapet wall at least 21 inches (53 cm) high: a) On or about 8/15/16, on the second floor at the Elk Terminal Lofts Construction Project, 230 Scott St., Buffalo, NY: Rooms 30 B and 31 B each contained a large L shaped hole where employees could fall 12 ft. to the floor below. Each room contained stored materials such as sheets of drywall used by other contractors on site. A wooden guardrail system was installed across each room running parallel to the outside wall, but there was a section in the center that lacked a midrail. This would allow employees of other contractors to enter the areas where the fall hazard existed. NO ABATEMENT CERTIFICATION REQUIRED
