29 CFR 1926.100(a):  Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns:      The employer does not protect each employee in its excavation by requiring employees to wear protective helmets when working in a trench where there is a possible danger of head injury from impact.      a)  This most recently occurred on August 15, 2016, at 744 W. Buckingham PL, Chicago, Illinois.  Employees working in a trench are not wearing protective helmets where there is a possible danger of head injury from falling objects.                To abate this hazard in the future, the employer must ensure that each employee is provided with protective helmets when working in a trench where there is a possible danger of head injury from impact.       Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including an explanation of how these steps protect it's employees from struck-by hazards.

29 CFR 1926.652(a)(1):  Each employee in an excavation is not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or 1926.652(c):        The employer does not protect each employee in its excavations by properly sloping the excavation or by using appropriate protective systems designed in accordance with paragraphs (b) or (c) of 29 CFR 1926.652.          a)  This most recently occurred on August 15, 2016, at 744 W. Buckingham PL, Chicago, Illinois. Employees are exposed to cave-in hazards while installing a sewer service in a trench without cave-in protection that is approximately 6 feet in depth.            To abate this hazard in the future, the employer must ensure that it's excavations are properly sloped, or that protective systems designed in accordance with this standard are used, and that no employees enter the excavations until protection is provided.      This employer has been cited for this practice that included: McDonagh Contractors, LLC, was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 1117967, citation number 2, item number 1 and was affirmed as a final order on June 28, 2016, with respect to a workplace located at 3757 N. Wayne Ave., Chicago, IL 60613.    Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including an explanation of how these steps protect it's employees from excavation cave-ins.

29 CFR 1926.651(c)(2):  A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees:       The employer does not provide a stairway, ladder, ramp or other safe means of egress to each employee when working in a trench approximately 6 feet deep.           a)  This most recently occurred on August 15, 2016, at 744 W. Buckingham Pl, Chicago, Illinois.  Employees are not provided with a safe means of egress when working in a trench approximately 6 feet deep.       To abate this hazard in the future, the employer must ensure that safe means of access and egress is provided to employees when working in the trench, and that no employees enter the trench until the safe means of access/egress is provided.         This employer has been cited for this practice that included: McDonagh Contractors, LLC, was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(c)(2), which was contained in OSHA inspection number 979310, citation number 1, item number 1 and was affirmed as a final order on July 10, 2014, with respect to a workplace located at 1909 S. State St., Chicago, Illinois 60616.        Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including an explanation of how these steps protect it's employees so that a safe means of access/egress is provided while working in excavations.
