29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c): a) On or about August 16, 2016, employees were exposed to cave-in hazards while working in an excavation having a depth of approximately 7 feet. Copenhaver Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1) which was contained in OSHA inspection number 1088448, citation 1, item 2, and was affirmed as a final order on November 12, 2015, with respect to a worksite located at Oakton Street and Nordica Ave., Niles, Illinois. Copenhaver Company, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1) which was contained in OSHA inspection number 977815, citation 1, item 2, and was affirmed as a final order on August 13, 2014, with respect to a worksite located at 514 Western, Park Ridge, Illinois. No abatement certification required for this violation.
