OSH ACT of 1970 Section (5)(a)(1):     Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm:               a) On or about 7/19/2016, at 960 Broadway, Albany, NY, employer failed to conduct a hazard assessment to determine whether hazards were present and in such quantities to necessitate the use of respiratory protection as personal protective equipment when assigning three employees to perform demolition at this location when there was reason to believe, under the circumstances of the situation, that hazards necessitating the need for respiratory equipment were present and that such equipment was not being provided by the host employer.  Feasible means of abatement include, but are not limited to, documenting discussion with the client/host employer pertaining to the presence of asbestos or lead at the jobsite and absence of personal protective equipment being provided by the client/host employer.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:      a) On or about 7/19/2016, 960 Broadway building second, third, and fourth floors, the laborers who were performing demolition and clean up activities and who were required to walk through areas where large sections of floors had been removed. No fall protection systems were utilized and/or no guardrails or safety nets were installed in these areas, thereby exposing the employees to a fall hazard of over 12 feet.

29 CFR 1926.501(b)(4)(ii): Each employee on a walking/working surface was not protected from tripping in or stepping into or through holes (including skylights) by covers:     a) On or about 7/19/2016, throughout 960 Broadway building, for the laborers who performing demolition and clean up activities and who were required to work in and walk through areas where there were floor holes measuring up to 4 feet by 4 feet which were not covered on the second, third, and fourth floors.
