29 CFR 1926.453(a)(1): Aerial lift was not designed or constructed in accordance with the applicable requirements of the American National Standard for "Vehicle Mounted Elevating and Rotating Work Platforms," A92.2-1969:    a)  At the jobsite, on or about 8/12/16:  An employee was directed into a bucket that was sitting on the forks of a rough terrain fork-truck, and where the bucket on the forks was elevated to a height of approximately 20 feet.  The bucket was not secured to the forks or mast of the fork-truck and subsequently slid off the forks causing the employee to fall with the bucket into a dumpster below.  This bucket was not designed for the purpose it was used for.

29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift:    a)  At the jobsite, on or about 8/12/16:  An employee was directed into a bucket that was sitting on the forks of a rough terrain fork-truck, and where the bucket on the forks was elevated to a height of approximately 20 feet.  The bucket was not secured to the forks or mast of the fork-truck and subsequently slid off the forks causing the employee to fall with the bucket into a dumpster below.  This bucket was not designed for the purpose it was used for and the employee was not attached to the boom or basket.

29 CFR 1926.602(d): The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l)(1)(I): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by successful completion of training and evaluation:     a)  At the jobsite, on or about 8/12/16:  The Foreman directed an employee to get into a material bucket placed on the forks of a rough terrain fork-lift, not designed for that purpose and not checked for positive connection; and who then elevated that employee in an unsafe manner, without fall protection, resulting in a failure of the bucket and subsequent fall of the employee.
