29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  a) At the job site, in front of the building, on or about August 18, 2016, an employee who operated the forklift had not been adequately trained, resulting in fall and struck-by or crushed-by hazards.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:  a) At the roof eave, on or about August 18, 2016, an employee who was performing framing work on the roof trusses of a new three-story hotel was exposed to fall hazards up to approximately 40 feet onto earthen ground because the worker was not fall protected.    b) On the 3rd floor parapet wall, on or about August 18, 2016, an employee who was standing on top of the parapet wall performing fascia work was exposed to fall hazards up to 36 feet onto earthen ground because the worker was not fall protected.    c) On the roof trusses, on or about August 18, 2016, two employees who were performing framing work from the roof trusses were exposed to fall hazards up to 9 feet onto the 3rd floor deck because the workers were not fall protected.

29 CFR 1926.1053(b)(13): The top or top step of a stepladder was used as a step:  a) At the job site, on or about August 18, 2016, an employee was observed siting on the top step of an 8-foot step ladder performing carpentry work on the facia of the roof trusses, as a result exposed the employee to a fall hazard.
