OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to fall hazards:      a) Shipping Dock/Warehouse- On or about August 13, 2016, employees were exposed to a fall hazard when using an 8 ft. Werner self-supporting A-frame ladder in the closed position. The ladder was used as a single ladder by leaning it against the side wall of the Shipping Office to access material stored above it. The employer did not ensure that the employees used appropriate equipment to retrieve stored materials.

29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards: Note: Toeboards are only required when persons can pass, there is moving equipment or there is equipment with which falling materials could create a hazard.      a) Shipping Dock/Warehouse- On or about August 13, 2016, the employer did not ensure that the mezzanine storage space over the Shipping & Receiving Office, which is approximately eight feet above ground level, was guarded with a standard railing or the equivalent when an employee accessed the area to retrieve plastic rolls.

29 CFR 1910.22(d)(1): On every building or other structure, or part thereof, used for mercantile, business, industrial or storage purposes, the loads approved by the building official were not marked on plates of approved design and securely affixed in a conspicuous place in each space to which they relate:    a) Shipping/Warehouse Area- On or about August 13, 2016, the space over the Shipping & Receiving Office was used as a mezzanine storage space and did not have a marked load capacity plate. The space was temporarily used to store rolls of plastic and one or two skids.
