(b) Chlorine Loading Shed: On or about August 28, 2016 the employer had not determined the codes and standards that would be followed in establishing the acceptable parameters, such as the valve closure rate, for the Powell Emergency Valve Closure System used on rail cars during chlorine loading.

(a) Chlorine Loading Shed: On or about September 27, 2016 and times prior the employer's testing and inspection procedures for the Powell Emergency Valve Closure System did not follow recognized and generally accepted good engineering practices in that the closure rate of the valves were tested but the closure time was not compared to any time parameters to determine if the system was functioning properly.

29 CFR 1910.1200(h)(3)(i): The employee training did not include the methods and observations used to detect the presence or release of a hazardous chemical in the work area: (a) Chlorine Loading Shed: On or about September 27, 2016 and times prior the employer had not trained employees on the readout display of the continuous chlorine sensors in the Load Shed. Employees were not aware that if a reading approached 1.0 parts per million on the display then they were approaching the OSHA permissible ceiling level.

29 CFR 1910.119(j)(2): The employer did not implement written procedures to maintain the on-going integrity of process equipment: (a) Chlorine Loading Shed: On or about September 27, 2016 and times prior the employer had not implemented company procedure 666281 on the replacement of chlorine loading hoses in that the loading hoses were not tagged with their in service date so that the time in use could be tracked. Company procedures required that the hoses are to be replaced after eighteen months of use.
