29 CFR 1910.1001(j)(3)(i): Building and facility owner(s) did not determine the presence, location, and quantity of asbestos containing material (ACM) and/or presumed asbestos containing material (PACM) at the work site. Employer(s) and building and facility owner(s) did not exercise due diligence in complying with these requirements to inform employer(s) and employee(s) about the presence and location of ACM and PACM. a) 168 Elizabeth Ave. Newark, NJ The employer failed to identify the presence, location and quantity of all ACM/PACM throughout the facility. Sampling conducted by OSHA indicated pipe insulation and floor tiles contained up to 80% Chrysotile asbestos and 6% Chrysotile asbestos, respectively. Condition occurred on or about 8/27/2016 Brantley Brothers Moving & Storage Co., Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.1101(k)(3)(i), which was contained in OSHA inspection number 1001669, citation number 1, item number 11a and was affirmed as a final order on 8/3/2015, with respect to a workplace located at 168 Elizabeth Ave., Newark, NJ.

29 CFR 1910.1001(j)(5)(i): The building owner(s) or employer(s) did not affix or post labels or signs on identified ACM and/or PACM that had been previously installed, so that employee(s) would be notified of what materials contained ACM and/or PACM. Labels were not affixed to all raw materials, mixtures, scrap, waste, debris, and other products containing asbestos fibers, or to their containers. The employer(s) did not attach such labels in area(s) where they would be clearly noticed by employee(s) who were likely to be exposed, such as at the entrance to mechanical room/areas: a) First Floor, south side stairwell The employer failed to affix labels to thermal systems insulation (TSI) around pipes found to contain 40% Chrysotile asbestos. b) Basement level, south side stairwell The employer failed to affix labels to thermal systems insulation (TSI) around pipes found to contain 30% Chrysotile asbestos. c) Basement level, south side near wall The employer failed to affix signs or labels to floor tiles found to contain 6% Chrysotile asbestos. d) Second floor, north side near exit The employer failed to affix signs or labels to floor tiles found to contain 4% Chrysotile asbestos. Condition occurred on or about 8/27/2016 Brantley Brothers Moving & Storage Co., Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.1101(k)(8)(i), which was contained in OSHA inspection number 1001669, citation number 1, item number 11b and was affirmed as a final order on 8/3/2015, with respect to a workplace located at 168 Elizabeth Ave., Newark, NJ.
