OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish the employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to falling and struck by hazards:    a)  Northwest corner of establishment:  On 8/28/16 an employee was unloading food and non-perishables from a van onto a VRC that was located on the sidewalk and traveled on level down to the basement of the restaurant. The employee was exposed to fall and struck-by hazards while loading the VRC. The VRC platform collapsed and the safety cam failed to engage to stop the falling platform. The victim fell into the shaft and was struck by one of the Bilco doors resulting in a fatal injuries. The Employer did not establish a maintenance program, that incorporated a qualified person to perform inspections and perform preventative maintenance and did not have a reliable method of ensuring that the VRC's maximum rated capacity was not exceeded.    NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
