OSH Act of 1970 Section 5(a)(1):  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to combustible PVC material dust fire hazards due to an indoor media-type dust collector that exhausted filtered air directly into the occupied building:  a) On or about September 6, 2016, the Dantherm Filtration indoor filter media-type dust collector (baghouse) was used for collecting combustible PVC dust from upstream process systems including grinders/granulators, air-material separators (cyclones), a pulverizer, silos, a packaging hopper, and various in-line fans/blowers:            i.          Employees were exposed to combustible PVC material dust fire hazards as the dust collector directly exhausted filtered air indoors without means to detect and prevent the transfer of the hazardous byproducts of a dust collection system fire (such as fire, embers, smoke, or toxic gases) into the facility through the dust collectors exhaust air system.

The company did not have a written respiratory protection program.

NEW WAVE PLASTICS SUCCESSOR BLUE OCEAN PLASTICS, LLC WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD, (1910.147(C)(1)), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER (949208), CITATION NUMBER 01, ITEM NUMBER 005, AND WAS AFFIRMED AS A FINAL ORDER ON (05/20/2015), WITH RESPECT TO A WORKPLACE LOCATED AT (5500 WALWORTH AVENUE CLEVELAND, OH 44102).
